Proposed Special Education Regulations

Proposed Special Education Regulations Take Action!

Advocates asked to contact Gov. Kaine

The Virginia Board of Education is proposing significant revisions to the "Regulations Governing Special Education Programs for Children with Disabilities in Virginia." Parents and advocates across Virginia oppose these draft regulations in their proposed form because they roll back important parental rights and protections for children with disabilities.
The Virginia Board of Education is proposing to take away parental rights and protections, including the elimination of the existing right of parent consent to the termination of ANY special education and related services. The current regulations require that parents must agree before a school can end a child's services. However, the proposed regulations state: "Prior to any partial or complete termination of special education and related services, the local educational agency shall comply with the prior written notice requirements of 8 VAC 20-81-170 C., but parental consent is not required."
In addition to the removal of the current protections regarding parent consent, advocates have a number of other concerns related to these proposed regulations. In the regulatory review process, Governor Kaine now has the option to return the proposed changes to the current special education regulations to the Virginia Board of Education for revision prior to releasing them for public comment. We urge advocates for students with disabilities to contact Gov. Kaine as soon as possible asking him to take the draft regulations "back to the drawing board".

Schools for Students with Disabilities Fund
Effective for taxable year 2007, changes to the provisions of the Neighborhood Assistance Act Credit created the Schools for Students with Disabilities Fund to receive donations for private schools for students with disabilities. The fund is administered by the Department of Education (DOE). Under the new provisions, DOE will certify and manage $3 million in credits to be used by private schools for students with disabilities.

Donor Information
Donors must apply to the Virginia Department of Education to receive tax credits for contributions to the Schools for Students With Disabilities Fund. Tax credits will be issued on a first-come, first-serve basis. Minimum and maximum limits for tax credits are established by the Code of Virginia.
Individual Donor:
The donation by an individual must be at least $500 per taxable year to be eligible for state tax credits. A maximum of $50,000 in tax credits may be imposed upon the individual donor if all available tax credits are allocated in a single year. (Additional provisions may apply in accordance with §63.2-2006.)
Business Donor:
State tax credits may be issued to any business entity authorized to do business in theCommonwealth of Virginia. For the business donor, no tax credit less than $400 or in excess of $175,000 shall be given in a taxable year. (Additional provisions may apply in accordance with §63.2-2003)
Making a Donation:
For assurance regarding the availability of tax credits, donors must apply for tax credits prior to making a donation using forms (business or individual) at the website http://www.doe/.virginia.gov/VDOE/sess/ssdf/index.html .
Once the donor receives authorization of tax credits, the Submission of Donation form must be completed and sent with the donation to the Virginia Department of Education.
Certificate of Tax Credit:
Upon receipt of a qualifying donation, the Virginia Department of Education issues to the donor a Certificate of Tax Credit and provides notification to the Virginia Department of Taxation. The Certificate of Tax Credit must accompany the donor’s tax return. Upon receipt of the Certificate of Tax Credit, pass-through business entities must file Form PTE with the Department of Taxation.

Wanted! Young Leaders
for the Virginia Board for People with Disabilities’
Youth Leadership Forum

The Virginia Board for People with Disabilities (VBPD) seeks candidates from across Virginia to serve as delegates to its 2008 Youth Leadership Forum (YLF). The 2008 Forum will be hosted at Christopher Newport University in Newport News from July 4-18, 2008. Twenty-five Virginia high school students with disabilities will be selected to receive full scholarships to participate in this exceptional leadership development program. Scholarships cover the entire cost for delegates to attend YLF, including transportation, room & board, instructional materials, activities, interpreters, personal care assistants, and individual medical care as required.

Sponsored by VBPD, the Forum’s goals are to educate students with disabilities about the principles of leadership, build their self-confidence and advocacy skills, and better prepare them for future career choices. Rising high school juniors and seniors who want to become leaders in their schools and communities are strongly encouraged to apply for the rewarding and privileged honor of serving as a 2008 YLF delegate.

CD-ROMs that include YLF 2008 information, application materials, and a YLF video vignette have been mailed to school districts and disability-related agencies throughout Virginia. To be considered, students’ applications must be post marked by no later than March 31, 2008.
